A Will County judge Wednesday denied a motion to dismiss two felony weapons charges against former Bolingbrook police sergeant Drew Peterson, the sole suspect in his wife’s disappearance.

The state can now proceed in its criminal case against Peterson, which alleges Peterson owned an AR-15 assault rifle that was too short under state law and that Peterson also illegally transferred the weapon to his son, Steve.

BREAKING NEWS: Judge denies dropping felony gun charges

A motion to dismiss felony weapons charges against Drew Peterson has been denied.

“For the defense to be successful at this stage, this court would be required to make certain assumptions on behalf of the defense and againt the state as to the intent and meaning of LEOSA,” said Judge Richard Schoenstedt. Given the burden as described, this court declines to do so.”

A pretrial date of Aug. 28 has been scheduled.

*UPDATE* Wawczak charged after altercation with Peterson

Len Wawczak

Len Wawczak, the apparent police spy who secretly recorded conversations with Drew Peterson, had no regrets Friday after being arrested for a fight with his former friend.

“I did all right I think,” Wawczak said after his release from the Bolingbrook police department “It was the best $100 I ever spent.”

Wawczak and Peterson, the sole suspect in his wife Stacy’s disappearance, both went voluntarily to the Bolingbrook police station Friday after the two scuffled in the parking lot of the Bolingbrook barbershop Hyroglyphics, 356 N. Schmidt Road, at about 1:30 p.m., according to a statement by police spokesman Lt. Ken Teppel.

Wawczak said he confronted Peterson after Wawczak’s 20-year-old son called him and said Peterson was giving him menacing looks while the two were in the barbershop.

“I asked him, ‘does it look like he’s trying to start (something) with you?’ and he said ‘I don’t know if he’s trying to start something but he’s trying to intimidate me,’” Wawczak said.

Wawczak told his son he’d be there in a few minutes and “flew down” to the barbershop.

He then found Peterson at a neighboring barbershop and waited in the parking lot to confront him.  Wawczak said Peterson remained non-chalant as he hurled insults at him and questioned him about his alleged conduct toward his son.

“I went up do him and said what’s up (expletive)? Why you trying (expletive) with my kid, Drew?” Wawczak said.

Wawczak said Peterson denied trying to scare his son and also denied reports that he told a television news reporter that he had slept with Wawczak’s wife, Paula Stark.
Peterson did not return calls seeking comment.

Earlier this week, Wawczak and Stark announced that they were police informants and had worn wires to record nearly seven months of conversations with Peterson.
Illinois State Police did not confirm or deny the reports.

Police are investigating the disappearance of Peterson’s wife and also the March 2004 death of his third wife, Kathleen Savio. Peterson has denied any involvement in the cases and has not been charged with a crime in either case.

Peterson and his attorney, Joel Brodsky, have remained calm about the wiretap allegations, saying if there are tapes, they would prove Peterson’s innocence. Both men said Wawczak and Stark are simply trying to profit off Peterson’s notoriety because they are having financial troubles.

Wawczak said he pushed Peterson twice during the altercation and told him to leave his family alone.

“I told him ‘stay away form my kids, stay away from Paula. Next time I’ll kick your (expletive) and you know I will,’” Wawczak said.

Teppel said Wawczak was charged at about 3:30 p.m. with misdemeanor battery based on Peterson’s statements and eyewitness testimony. He was given a court date of Sept. 10.

“Drew ain’t gonna be able to show up on that day because he’s going to be arrested by (then),” Wawczak said. “I don’t care because he’s a punk. This is what he needs.”

Drew Peterson’s former firend Len Wawczak was charged with battery Firday after the two argued outside a Bolingbrook barbershop.

Bolingbrook police were called to Hyroglypics, 356 N. Schmidt Rd., at about 1:30 p.m. for reports that the two men were fighting in the barbershop’s parking lot, according to a statement released by Bolingbrook police spokesman Lt. Ken Teppel.

Wawczak allegedly confronted Peterson in the parking lot and began yelling obscenities at him, according to reports. The altercation came two days after Wawczak and his wife Paula Stark told media outlets that they had worn police-issued wires to record nearly seven months of conversations with the former Bolingbrook police sergeant who is the sole suspect in his fourth wife’s disappearance.

Wawczak was allegedly disturbed by reports that Peterson had told people he had sex with Stark. Peterson, according to reports, had turned his back while Wawczak was yelling at him, when Wawczak pushed him from behind.

Both men voluntarily went to the police station to provide written statements, Teppel said. Police charged Wawczak at about 3:30 p.m. with a local battery violation based on Peterson’s statements and eyewitness testimony.

Teppel said Peterson had been released from the police station. Wawczak was still being processed as of 4:40 p.m.
