Drew Peterson’s lawyers were back in court today under a new Will County judge, Stephen White, who was assigned to the case on Monday.

JOLIET, Ill. – A judge is making it tougher for Drew Peterson to talk to the media from jail.

Will County Judge Stephen White ordered Peterson’s lawyers on Wednesday to give him phone numbers of family, friends and attorneys that Peterson calls. Peterson has to notify the jail if he wants to call anyone else.

The judge’s order comes after Peterson called a radio show from jail. White also wants to be notified on all interviews and press releases, and he ordered the names of witnesses and potential witnesses be sealed.

Peterson has pleaded not guilty to first-degree murder in the 2004 death of his third wife Kathleen Savio. He’s also a suspect in the 2007 disappearance of his fourth wife, Stacy.

White set the trial date for August 24th.

    In an effort to curtail media contacts that Drew Peterson has been making from the Will County jail, a judge today restricted the former Bolingbrook police officer to only making calls to friends, family and his lawyers.

    Will County Judge Stephen White demanded the telephone numbers of those people and said Peterson, who is charged with the 2004 killing of his wife Kathleen Savio, is limited to calling only them while he is behind bars.

    White also said that anyone associated with the case, including Peterson, his defense lawyers and prosecutors, must notify the judge before conducting any media interviews.

    Also today, White ordered sealed lists of witnesses who could be called in Peterson’s upcoming trial.

    Prosecutors also turned over six cardboard boxes full of discovery documents to defense lawyers.

    Last week, prosecutors filed motions to seal all discovery documents and to modify the conditions under which Peterson can see his attorneys in jail.

    The latter motion asks the judge to require that Peterson’s attorneys use the jail’s video conference system for visits unless there’s a “specific need” for a face-to-face visit in which case attorneys must schedule it with jail staff at least 24 hours in advance.

    But White turned down that request and said that defense lawyers should be courteous and give notice to the jail staff.

    Chief Judge Gerald Kinney allowed Peterson’s defense team unlimited contact visits in a May 18 order.

    It also asks that the judge only allow contact visits for purpose of discussing Peterson’s case, noting that one of Peterson’s attorneys, Joel Brodsky, began playing a card game with Peterson 10 minutes into an afternoon visit on May 24.

    White barred the card games and said, “If they were allowed to play at will, there would be a Texas Hold ‘em tournament at the end of the month.”

    Prosecutors had sought to have the judge to order that all discovery documents be filed under seal and that all attorneys on the case be prohibited to release any information from them. Prosecutors were to turn over their discovery on Monday; defense attorneys have until June 8.

    The motion also said that potential witnesses in the case are concerned about “possible public harassment” and notes that the judge in the Christopher Vaughn quadruple-murder case previously ordered that the discovery documents be placed under seal.

    Some documents detailing the Peterson investigation were stolen from a locked Illinois State Police squad car parked inside a garage in 2007, prosecutors said in the motion, copies of which were reportedly obtained by Fox News in April.

    The station early in May contacted a potential witness whose name was in the documents and asked her for comment.

  9. It’s a clever ruling. If JB wanted to argue they need to make something public to help them look for any unknown witnesses or anything else remotely sensible, the Judge can grant it, but if they have to run anything silly, the judge can stop him.

  10. Seems like 1/2 a gag order, which is fine. At least someone has a handle on this.
    The appelete court is supposed to rule on bond reduction in a week or so.
    Court date for trial set for Aug. 24th.
    Of course Brodsky will try to have the trial moved.

  12. It sounds to me like another reality check for Drew and Joel. I see more teeth
    in this ruling as someone else stated ,in ‘showing some respect for the Court
    proceedings. I have been appalled by their actions for a very long time. Advantage; The people for justice in Illinois. There is a long way to go but
    finally the wheels of justice are beginning to move forward.

Hope Brodsky craps his pants when he finds materials in those files about all the media interviews he did with Drew that point out all the inconsistencies the prosecution’s going to use against them. I’ll bet that’s not going to be a “white noise” moment — more like a brown blast. Couldn’t happen to a more deserving guy.

  18. I read today’s article with glee and can’t wipe the smirk off my face. As JAH said, Brodsky is truly in over his head. He is an amateur trying to play with the big boys and it’s quite funny to see him floundering around.

    This must be absolutely killing him! His strategy of playing it out in the media – “it got OJ off” – has bit in in the ass. What will he do now?

    Does anybody know what the ramifications are if he disobeys the ruling and leaks stuff to the media???

    I’m also curious about whether or not, if they do have anything pertinent, they will hand it over. When it comes to this defence team, they were too busy preening in front of the mirror the day ehtics and brains were handed out.

  26. Well, he hasn’t come up with much yet on Kathleen except that she was a hellcat. So what? I’m old, been accused many times of being a hellcat myself, and I’m proud of it. He’s tried to trash her family, but they sure have seemed to stand the test of his insults and time. Last time I saw a video of them in front of the Courthouse, they were all united and looking pretty darn good to me.

  30. Sugar, I was thinking of that too, all the effort Drew’s defense has taken to paint Kathleen as a spirited, aggressive person. For argument’s sake, let’s say she was. It still wouldn’t disprove any of the evidence the state might bring in to show how he threatened, stalked and attacked her.

  31. Let’s keep in mind, it’s not Joel’s job to prove Drew innocent, only to tear apart the case of the prosecution. So far, he’s tried to win the case on technicalities (before it’s even started). He doesn’t really need to have a lot of his own evidence, just enough to get a jury to have a reasonable doubt as to Drew’s guilt.

  33. The prosecution seems to have a lot of circumstantial evidence. The question will be, does it amount to so much that it can overcome any reasonable doubt?

    For instance, there doesn’t seem to be any physical evidence putting Drew in Kathleen’s house the weekend of her death.

    But, if the judge allows the evidence showing that he admits he had broken into her house on earlier occasions, and the hearsay statements from Neil Schori…that would be pretty powerful stuff to me if I was sitting on the jury!

    I wish they would televise the trial!

    The Defense can try and unravel the prosecutions evidence until the cows come home, but it will be Drews pathological lying that will get him undone in the end !

    Brodsky countered that he needs to be able to talk to the media, saying publicity might prompt potential witnesses to come forward with relevant information.

    The judge set an Aug. 24 trial date.

    Brodsky, who can ask for a continuance, said it was a realistic date as long as Peterson is in custody.

    Glasgow said he expects the defense to move for a change of venue because of the publicity.

    Brodsky did not address the change of venue, but has said the defense is considering that.

    This works out to reading/understanding/preparing an average of close to 1.000 pages per week or 200 pages per day, based on a 5 day working week and if they’re not doing anything else (!!)

    No more time for playing cards anyway !

    Kitty died in 2004. The grand jury sat for 18 months.

    I first heard about Stacy Peterson only three days after she went missing. I was working for the police at the time and had just ended a four year relationship with a sociopathic abuser. I was googling abusive police officers and Stacy came up and I started following the case.

    My ex used to refer to me as “miss feisty” every time I opened my mouth to express an opinion. After a very short period of time it pissed me off so badly that I WOULD grow “feisty” with him.

    Poor Kitty was just doing what anyone has the right to do: standing up to her abuser and being in control of her own life, and the abuser can’t take it. She is rebelling against his authority! She is a “hellcat”.

    I’m gonna open a nice bottle of champagne and toast Kitty Savio the day that POS is found guilty!

  49. Somebody made a crack about rogaine earlier and I had to laugh. A friend of mine looked into using it, but decided against it when he read the label and realised you must CONTINUE to use it. Once you stop, the thinning/baldness comes back.

    I too have noticed that the prisoner’s hair has thinned a LOT since he was chucked in the slammer. Sucks to be you Drew.

    I don’t see how the defence could have any discovery worth a damn when it comes to Kitty. He thought he executed the perfect crime. It was almost four years from her death to him coming under suspicion.

    I also think the stinky scenario that went down when they discovered her body will be ripped apart by Glasgow in the courtroom. Hell, we all smelled the rat through our computers when we first heard about it. That story was BS and is full of holes. I would love to see how Boobsky goes up against Glasgow on that.

    Speaking of Nurse Pauline (Brodsky’s li’l Bitch), and keeping in mind that he is the man who was provided with discovery materials by Joel, who outed the last name of a witness for the prosecution, and who then proceed to personally harrass the man by calling him at home and questioning him about details of the case, he’s all in a huff tonight over the decisions made by the honorable Stephen White of Will County. Only, here’s the funny part, he doesn’t accept the restrictions upon Drew as the decision of a judge. Instead, he seems to be crediting…us!?

    As he’s sitting in the Will County Jail murder suspect Drew Peterson wants to endlessly talk to anyone who will listen. Some people are up in arms over this and just want Peterson to shut up.

    These are the same detractors that demanded Peterson’s hanging despite an arrest, trial or conviction. These harpies are misguided and need to get a life. Police and prosecutors usually pray for suspects to say anything at all. In America most crimes are solved by the suspect’s own big mouths. It’s always better to keep the suspects talking. The same holds true for Drew Peterson.

    If Drew Peterson is really guilty, please let him talk! If Peterson is not guilty he deserves the right to talk. Right now Peterson is presumed innocent and should be able to say whatever he wants. Should any man not yet convicted lose the right to claim his innocence?

    Another not so small issue surrounds the government’s discovery material (the entire police report). By law they must turn it all over to the defense so they may prepare for trial. Prosecutors also got an order from Judge Stephen White precluding the defense from releasing any discovery information to the media. Why do they want that you’d ask? It’s really quite simple when information is released to the public people come forward with information about the players named in the case.

    The prosecutors and State Police know that many of the people involved are very dirty and will be exposed by the press. Before it’s over I’d expect that sunshine on the government witnesses may reveal just what happened to Stacy Peterson and it won’t fit the prosecutions model or help convict Drew Peterson.

    Here the police make public whatever they want but should Peterson’s defense team release any information the prosecutors cry foul. Not fair you say? Who said government wants to be fair?

  74. It’s difficult to give a blog such as paulie’s any credibility when they a) won’t post comments that detract from their view, and b) spout lots of misinformation.

    What I love about this blog is that we are able to respectfully debate, and if we get off track and start getting into high drama and wild speculation, or wrongly impugn somebody, facs and rescue pull us in to line. That gives us credibility.

  80. Protecting witnesses in the case was justified not only because of Brodsky’s and Drew’s big mouth.
    When Kathleen Savio’s family wanted her estate to be reopened, Brodsky and Abood said they were going to be very tough to the witnesses. If Glasgow hadn’t asked the judge for the gag order, I am sure they would harrass them, use any false or fabricated stories from their lives and present even fake evidence to depreciate them. We could foretest all of it with Thomas Morphey and his photos taken 10 years ago and presenting him in a bad light.
    Taking into consideration the fact that Drew and his son were accused of using improper use of the police database, we can be sure that Drew knows many details on each person who was close to Kathleen or Stacy. That could discourage some witnesses to testify.
    All in all, that was a great move of Glasgow to shut Drew&Brodsky Co. up. It was like to disarm the enemy
    following the Geneva Convention rules. Handling the case in velvet gloves ;).

    BTW, I think it must be horrible for such a controlling freak like Drew not to be able to control the things anymore. No matter what Brodsky says about Drew being in good shape, Drew looks worse and worse, and he is not looking at the cameras anymore.

    I think I know what you’re referring to…there was discussion yonks and yonks ago about when DP went on his 3 day trip. It was said that he was seen going off on a bike, but not seen coming back on one, then he was seen on his bike, so people wondered if he had sold hers or given it away as payment while he was away.

    Not sure how it was resolved, think he was seen with her bike subsequently. :-)

    JOLIET — Drew Peterson’s days of card playing with his lawyer and calling into radio shows from the county jail appear to be over.

    Judge Stephen White ordered Peterson to compile a list of phone numbers for his family, friends and attorneys, and told the accused wife-murderer to limit his calls to these people.

    White made the ruling during a Wednesday afternoon hearing in which he also ordered Peterson’s attorneys to contact him and the state’s Attorney Registration & Disciplinary Commission if they plan to appear on television or grant interviews to the media.

    On top of that, Assistant State’s Attorney Nicole Moore argued at the hearing that Peterson should be forbidden from playing cards with his attorneys when they visit him in jail. Peterson and one of his attorneys, Joel Brodsky, were caught in the middle of a game last month.

    The face-to-face visits with his attorneys are a special privilege and a burden on the jail’s staff, Moore said.

    White actually shot down Moore’s case, but Brodsky conceded he and Peterson will not be playing anymore.

    “(White) didn’t say no card playing,” Brodsky said. “He said abide by the rules of the jail.”

    And while there may be no regulations forbidding card playing on the books, Brodsky said, “I’m assuming the jail has changed its rules to prohibit card playing.”

    Another of Peterson’s attorneys, Andrew Abood, explained that Brodsky was playing cards with Peterson in an attempt to calm him.

    “He was trying to relax his client in an uncomfortable environment,” Abood said, claiming that spending nearly the last month in isolation has made Peterson “sluggish and slow.”

    Peterson has been segregated from other inmates because he is a former police officer and due to the notoriety of his murder case.

    At the conclusion of the hearing, prosecutors turned over six cardboard boxes containing two copies of discovery documents numbering 9,464 pages each. Peterson’s attorneys have a week to surrender their discovery evidence to the state.

    White ruled that the names of all witnesses be kept secret and prohibited attorneys from publicly identifying them.

    The ruling by White was less than what State’s Attorney James Glasgow had asked for. Glasgow last week requested a gag order be imposed on all discovery evidence. Brodsky objected to this and claimed publicity was beneficial to the defense of Peterson.

    “When things are published in the newspapers, people come forward,” he said.

    “That helps our defense,” Brodsky said. “We don’t have a team of 100 investigators.”

    White scheduled Peterson’s trial to start Aug. 24, but Brodsky said that some time before that date he will file to either have the case taken out of Will County or to have a jury shipped in from elsewhere.

James Glasgow lambasted the Chicago-Kent College of Law and a WGN radio show for staging a mock trial of the Peterson case last week, saying he’d called a school dean, the show and the Illinois Attorney Registration & Disciplinary Commission to try and prevent the “abhorrent” event, which ended with a hung jury.

    Chicago-Kent College of Law Dean Harold Krent said WGN contacted both sides in advance of the mock trial but he didn’t hear of Glasgow’s objections until the prosecutor left him a message the day of the event.

    “I think he’s over-reacting,” he said. “It’s already been on national TV. Even if people paid attention to this, I think it’s a far cry from tainting the jury pool.”

While I find it unusual that the defense is whining about being placed under a gag order relating to the exposure of witnesses against DP in the public, unless I am misunderstanding something here, the gag order doesn’t say anything about leaking out to the public other pieces of evidence against Peterson, like electronic phone records, or even evidence of DP being in possession of a particular weapon or police issued gear that might match up to markings on Kathleen’s, say, ankles and legs.

    I know, personally, I’d be very interested in hearing the defense “leak out” a plausible explanation for this:

    a dead woman, death by drowning, in a dry bath tub, naked, with no disposed of clothes either on the floor or nearby, or fresh clothes to wear after bathing, no clean linens to dry off with, a gash on the back of her head that caused her to fly around the room erratically and generate constant and numerous bruising all over her body, but blood from the gash only seen on her, and no where else around the room, which then caused her to head straight for a tub full of water to fall into, face down, to drown in, which water happened to leak out entirely all on its own. Oh, and manage to incur two identical bruise markings on her ankles while flying erratically around the room due to the gash in her head.

    Explanation? Leak it baby, leak it.

  114. Let’s see if we can help the defense out here.

    Drew had the children for the weekend, so even though Kathleen liked to horse around with the kids and bruised herself up doing it, not this weekend. So, the fresh bruises on her body, well, this is how it probably went down.

    1) Kathleen decided to take a bath. She filled her tub full of water. We “know” that because it’s been reported that she drowned, but the water slowly leaked out. She was apparently fine during this bath tub filling because she was not found with the faucet running. Nope. Turned off. Bone dry tub. Apparently, while the tub was filling, she did not get herself night clothes or clean linens, so we’ll have to fill-in the gaps ourselves as to what she could have been doing during this time. After the tub filled, she turned off the running water.

    2) Prior to her filling the bath tub, she apparently got naked. The time of her nakedness, I suppose, can be debated. Maybe she got up in the morning, got naked, and spent the whole day walking around the house that way. See, that would explain why there were no disposed of clothes anywhere near the bath tub or in the adjacent bedroom. Also, after her bath, she intended to stay naked. I suppose she was going to air dry herself off, which explains why there were no clean towels nearby. Certainly, she had time to get clean, dry towels while the tub was filling, but didn’t. Yep, we’ll go with the air dry theory here.

    3) Okay, so now we have a naked woman, a running faucet, a tub full of water, no night clothes and no towels. She attentively shuts off the water, and then…….

    4) I know. She maybe stuck her head in the full tub of water to check on the leaky drain Peterson said was an issue with that tub (the kids told him the water leaked out during their baths, or something like that). While coming up out of the water, she bonks her head on the faucet, causing a gash to her head, which begins to bleed. She tries to stand up, furiously runs around the room in a frenzy, bruising herself up on everything, but manages to keep the blood from her gashed head from dripping anywhere. Instead of falling onto her bed, or near the phone to call for help, being delirious from the head gash, she goes back to the bath tub and falls in the tub full of water. See, it was all an accident, just like they said it was.

    The rest is history.

I’ll bet Jowlsky’s words and tactics will have me (literally) screaming, but I can’t wait to hear what they’ll have to say for the simple reason that, at least so far, the only plausible explanation for Kitty’s death is she was murdered by her ex-husband for attempting to continue her life.

So, if the death scene and following death investigation can be presented to DP’s jury that gives them a reason to think she either died accidentally or, in the alternative, at the hands of another, then I assume they’ll have to show why it wasn’t her ex-husband and who the real killer may be.

    See how simple that is?

  126. I like your story, rescue, but it is difficult to belive in it because it was March and it was too cold not to wear clothes at home.

    I took some docs from Brodsky’s open car today and I learnt the real version:

    Kathleen committed suicide and staged it to look as a murder so that Drew went to jail.
    She put all the documents on the bed, hit her head over the night table and was lying on the carpet waiting for Drew to come. All of sudden she got ashamed that he could find her dirty, so she went to the bathroom, took a shower and decided to stage the scene in the tub. Of course, she was not picking up the phone so that Drew had come and been the first one on the scene. When Drew finally came she was still alive (Drew checked her pulse) and Drew, the neighbours and the BB/ISP police took her to the doctor. In fact, that was the doctor running her check-up who really killed her during the procedure and he honestly confessed it in the documents if you carefully read them (autopsy was performed at 2 pm. and Kathleen died at 11 pm, on 1 March 2004).
    This is – among others – the reason why Brodsky wants the trial to take place on Mars. All the judges in IL are involved in covering this unfortunate check-up and nobody wants to believe Drew. BTW, people in IL are great but UFOs will compose much more objective jury.

  151. Some really funny things being said on here today. I can picture Joel at home perhaps in his study thumbing through the boxes. He starts to shake his head and heads for the garage and stares at the same rifle he wanted to kill himself with a while back. He knows Drew is done. Without being disrespectful of Joel Brodsky, I am beginning to think Joel truly did believe “the State had nothing on Drew or he would have been arrested a long time ago” and now he’s received 6 cardboard boxes, containing approximately 9.400 documents (!!) of discovery, his head must be spinning as based on the previous motions he submitted there is no way he will be able to digest any of it, let alone process it into any form of coherency or clarity.

    He is no match for the States Attorney and as soon as Joel is going to be challenged during Court proceedings, he will lose it and display more of his bizarre Courtroom behavior, probably throw a temper tantrum or two or at best severely disrupt proceedings with his antics.

    I bet it is going to be one of the strangest trials we’ve ever seen (!!)

    JAH, I’m wondering the same thing. Joel doesn’t look to me like anyone associated w/work-pretty soft, isn’t he? I mean, he even lets his client run the defense. I can see him saying, “Oh, just leave it there. The burden of proof is on them, not us. Drew will have a plan.”
    The part he’s missing is the part where all the defense has to do sometimes is keep their mouths shut, a la’ OJ, and let the prosecution ruin their own show. Well, too late for that.
    Dear God, please keep Gil Garcetti et al out of our courtroom. Amen.

    I’m curious about how long it’s going to take for Brodsky to come up for air and get Selig and Armstrong on the horn to plan their strategy to still claim there’s no case in those six boxes of discovery. I can see it all now. Armstrong will flip yet again, based on his new criminal investigations and unidentified reliable sources who have come forward to share their bombshells with him only.

  167. Being “charming” and a Police Officer would have been a dangerous combination, especially to young girls and their parents.

    Remember he “helped out” troubled girls, befriended and “helped” their parents.

    By being “charming”, “helpful” and a Police Officer, he automatically had easy access to a lot of girls/women/families and his initial stalking would have been perceived as “caring”.

    Also interesting to note a lot of these women/girls didn’t even know he was married.

    I believe he initially told Stacy he was single(!!)too.

    Don’t know what he told Kathleen, but he turned on the charm with romance and trips away etc

    I am very happy to have found your blog recently. I used to be on Stacy’s blog till they closed it. I am watching this case since the beginning, and living in Canada. I am much interested that justice comes in for the victims in the hands of DP.

    I am keen to bring my thoughts on the case here, as I much appreciate your approach.

    I think very much so, that this DP has played cards since the onset of Stacy’s diseappearance to offset future trial – eg (no fair trial possible). I truly believe DP is a murderer, he has all the traits.

    Thank you for letting me be here with you, and I am still praying for justice to come.

    (PRNewsChannel) / Chicago, Ill. / The following is a statement from Joel A. Brodsky, lead defense attorney for Drew Peterson, on today’s ruling from the Illinois Third District Appellate Court denying Drew Peterson’s petition to reduce the amount of his bail.

    “We’re disappointed in the ruling from the Illinois Third District Appellate Court, but we accept the Court’s ruling. However, we are also confident that as the weakness of the State’s case is exposed over the following weeks and months we will have another opportunity to ask for a reduction in bond.”

    All I can say to Brodsky is keep dreaming……After this case he may want to look for a new career.

  172. I am sure ” the thing ” was very good at laying it on thick. Predators study their prey carefully. Most women enjoy attention and couple that with a cops uniform and thats a winning combination. How much you wanna bet ” the thing ” gave confiscated drugs and weed to his special young targets ? That’s not unheard of. How many abuses of his position of authority and trust has he commited ? The blue wall should not be protecting these type of cops but it does. It makes my blood boil when I think about how many times KS asked for help. I hope her estate rips all of them a new one. We hellcats need to demand that
    all of those derelict in duty be held accountable.
