Peterson attorneys seek notes of Savio statement

Attorneys for Drew Peterson, charged with murdering his third wife Kathleen Savio, alleged in court Friday that a sworn statement she made to an insurance-company lawyer contradicts her account that Peterson broke into their home in 2002 and threatened her with a knife. Peterson’s defense attorneys are seeking a copy of the notes made by an attorney working for Country Companies Insurance. Three letters written by the attorney have already been turned over to the defense team, said Peterson attorney Joel Brodsky.

They are seeking two others as well as notes the attorney made during Savio’s August 6, 2003, sworn statement. Brodsky said the documents should not be protected by attorney-client privilege because Country Companies has twice turned them over to prosecutors.

“When the defense issues subpoenas, then all of a sudden (it’s privileged),” said Brodsky, who said the notes could be crucial to demonstrating that certain hearsay statements not be admitted at trial.

Mark Ruda, an attorney for the insurance company, said the letters were turned over by mistake.

“The disclosure was inadvertent,” he said. “There was no intent to waive privilege.”
Judge Stephen White said he would look over the documents and issue an order, but said that “at this juncture” it appeared the notes would be protected.

A hearing before Judge White to determine whether hearsay evidence would be allowed during a jury trial is scheduled to begin Jan. 19.

On three different occasions I have tried to reach you over the phone regarding charges I filed against Drew Peterson on the date of July 5, 2002.

Note, I did contact the Police Dept and talked to the Asst Chief Mike Calcagno, in reference to Drew Break in the same weekend. I than filed a report in regards to my safety, from Drew by two officer that arrive at my residents 392 Pheasant Chase, Bolingbrook, Il. 60490.

When I found out Mr Peterson was having an affair with a minor at the police department, he began to get very violent. By strking me with his hand and chasing me through the house with a police stick. At that time on record, I had to get an order of protection from him.

Their has been several times throughout my marriage with this man where I ended up at the emergency room in Bolingbrook for injuries, and I have reported this only to have the police leave my home without filing any reports.

On July 5th, Mr. Peterson got into my home with a garage door opener he programmed for himself, while I was out of town with my son’s. I was unaware of his presents, and was very afraid for my live. This man pop out from our living room while I was walking down stair, with a basket of laundry. I was shocked and dropped all the cloths and sood their, asking him to get out. Drew was in uniform (swat Uniform) with his police radio in his ear. He yelled, for me to sit down and be quiet I refused and he pushed me on the stairs. He told me to move down to the third step and not to move or speak. He was very angry that in our divorce the judge ruled he would have to pay me child support. He told me he didnt want to pay me anything. (He left my boys 8 and 9, and I With many bills, up to 2,000.00 and with an 11,000.00 income tax bill, as well as a 6800.00 property tax bill for us to pay. Needless to say we are without money of any credit) He kept me in position for a very long length of time, while trying to convince me how horrible I am, and i just need to die. He asked me several times If I was afraid, I started to panic! He pulled out his knife, that he kept around his leg and brought it to my neck. I thought I’d never see my boys again. I just told him to end this craziness and he for some reason pulled back. I didnt tell the police because I know they can’t protect me from him. I know he will be back; he’s now attempting to try to make me look like the bad guy, with untrue charges of Battery against him, and his 17 yr. Girlfriend. The sick thing is I really think they’re enjoying this. Over the summer they went out of their way to roller blade right in front of my home, drive by and stop for long lengths of time in front of the house. Childish things like his girl friend flipping me off if I was out in front with the kids while driving by.

At the present time my children have been in a program at school called rainbows, in efforts to repair some of the damage Drew and his girlfirend has created. One of which Drew falsely arrested me in front of my children with my face in the grass, and calling me a criminal for hitting his girlfriend, which didn’t happen. Instead, she called me a bounce of inappropriate name in front of my children, so I felt it was necessary to get them back in the house away from this. When I ran to the truck, it being very high up I notices Stacy his girl friend taping me, with the stolen camera Drew took from our home.
I attempted to take the camera and my next goal was to return to my home with my children. But I was thrown to the ground and treated like an outlaw, and booked and arrested for no reason. My wrist was sprained, when I was being thrown to the ground and held down by Drew, who was not on duty at the time. While this was happening my children were being held against their own will, by Stacy Cales, while she told them to sit down and be quiet. My son’s phyc is working with them but states, “she cant fix what continue to happen on a on going basis’. My eight year old come home from spending 1 hour with his dad, because he really is never there, and pushes his sons and girlfriend on my son all the time, and expressed to me that he was confused! It seemed that Drews live in girlfriend showed both my sons her wedding dress and ring, and told them she was going to marry their father. Of course that’s ok, for Adults, but when my boys come home with tears in their eyes, still hoping for mom and dad to get back together again, it become heart breaking and very confusing to them. They don’t understand how dad can get married if he’s still married to their mommy. The list goes on, and I understand it’s just part of it, but it need to stop. My sons and I would like to move away from this area, for our safety and sanctity. I am a full time Nursing Student and Drew left me while in the middle of the program. I dont want my career or my sons to suffer this nightmare anymore.

He knows how to manipulate the system, and his next step is to take my children away. Or Kill me instead.

I really would like to know why this man wasnt charged with this unlawful entry, and attempt on my life. I am willing to take any test you want me to take to prove my innocents of charges against me, and also any lie detector test, on the my statement I filed against him. I really feel, Drew is a loose cannon, he out on the streets of Bolingbrook patrolling, and just taking the law into his own hands. I haven’t received help from the Police here in Bolingbrook, and asking for your help now. Before It’s to late. I really hope by filiing this charge it might stop him from trying to hurt us.

JOLIET — Prosecutors want a Canadian publisher who penned a book about Drew Peterson to stop playing reporter.

Derek Armstrong, the operator of Kunati Publishing and the author of the account “Drew Peterson Exposed,” invoked journalistic privilege when the state police contacted him about testifying before a grand jury in November 2008.

But prosecutors filed a motion Tuesday claiming Armstrong was no reporter when he was supposedly “spending hundreds of hours interviewing key players” in the Drew Peterson case.

According to the motion, “Armstrong was not a reporter” since he was not “collecting, writing or editing news for publication” on a full or part-time basis.

In some situations, news reporters are protected from handing some information over to police or the court. That privilege isn’t ironclad and doesn’t extend to all people who write.

Armstrong failed to return calls for comment, as did Peterson’s attorney, Joel Brodsky.

Taped interviews
Peterson also could not be reached, but he is being held in the county jail on a $2 million bond while he waits to stand trial for the 2004 murder of his third wife, Kathleen Savio. Peterson is also a suspect in the 2007 disappearance of his fourth wife, Stacy Peterson. The state police continue to investigate the mystery of the missing Stacy Peterson, a case they called a “potential homicide,” and have yet to bring charges against Drew Peterson or anyone else.

The state’s attorney’s office wants Armstrong to turn over taped interviews with Peterson, which he had previously refused to do. Charles B. Pelkie, the spokesman for State’s Attorney James Glasgow, declined to comment on the motion filed this week.

Allegations in books
In his book on the Peterson case, which was released in October 2008, Armstrong’s descriptions of some events contradict what members of the media witnessed. He also claims Stacy’s brother, Yelton Cales, “sexually touches (Stacy) several times” in 1990, when Stacy would have been 15 or 16 years old. Armstrong attributes this accusation to Stacy Peterson, but he apparently had never met or spoken with her.

Cales is a convicted sex offender, but he was never charged with abusing Stacy.

Besides the prospect of being forced before a grand jury, Armstrong might also be contending with his publishing house going belly up.

According to an Aug. 28 news story on the Web site for publishing trade publication Quill & Quire, “After just over two years in business, Kunati Books is folding.”

Peterson’s house going to auction block?

Scoopsville: Huh? Sneed hears an attorney for jailed murder suspect Drew Peterson is hoping to rent out/auction off Peterson’s empty Bolingbrook home for broadcast use during his upcoming trial!

“We are thinking it could be an excellent site for a news broadcast during the trial,” said attorney Walter Maksym, who filed a federal suit against JP Morgan Chase bank recently for suspending Peterson’s access to his $220,000 credit line.

“It would be a perfect place for someone like Geraldo Rivera. Don’t you think?” Maksym told Sneed.

Peterson, who is in jail charged with the murder of his third wife, Kathleen Savio, was hoping to use the credit line to post part of his bond, pay his attorneys and hire expert witnesses. The credit line was authorized in 2005 and suspended by the bank in May.

“If he can’t pay for his own defense, the taxpayers could wind up paying for the enormous cost of the defense,” Maksym said. “I’m not handling his murder case. I’m working with his attorney Joel Brodsky, who is vigorously defending him, and we are looking for any way possible to raise money so Peterson won’t be denied a fair trial. The bank severed his credit line because Peterson is being detained for trial, and we believe it violates federal law.”

Auctioneer Leslie Hindman tells Sneed she received a call from Maksym on Tuesday wondering if she might auction off “the use of Peterson’s house as a site for broadcast during the trial.”

Quoth Hindman: “I said, ‘No. I’m not interested in doing such a thing. It would be much too weird.’ ”

The Peterson home, which once housed his missing fourth wife, Stacy, and four children, has been vacant since Peterson was incarcerated in May.

Jim Pretto told ABC News back in February of 2008 that if they had known all the facts about the case in 2004, he would have called Kathleen Savio’s death a homicide.

“There was no evidence at all to point toward it being a murder,” Pretto said. “There was nothing presented at all.” Pretto said that though the jurors on the coroner’s inquest were suspicious, they did not have enough evidence to call Savio’s death anything but an accident.

“We had no other alternative,” he said. “I think more evidence should have been presented, more investigation should have been done at the time.”

We’ve all seen the complete inquest transcript now.  Yes, there was no testimony or evidence presented to the jurors to indicate that foul play might be suspected.  In fact, ISP Officer Herbert Hardy said otherwise.  One panel member (Dennis Pratl) made it personal, and said Drew Peterson was a good guy.   Yet, Jim Pretto wishes they had listened more to Kathleen’s family. The jurors did not hear about Savio asking for a restraining order against Peterson, and they were told by the ISP officer that there were no insurance policies involved. They did not hear about the police being called eighteen times to intervene in their disputes.

Several questions arise about these claims made by Pretto.  Who exactly was responsible for making sure these important issues were presented to the jury panel?  Or, in the alternative, who was responsible for making sure they were not presented to the jury panel?   Oversight or out-of-sight.  Which is it?

At the time of this juror’s interview, Anna Doman said:  “I think we’re closer” to justice. “I just wish it was four years ago.”

Plaque and tree honoring Stacy Peterson

A tree and plaque commemorating missing mom, Stacy Peterson, were dug up and stolen from in front of the Bolingbrook Aquatic Center overnight, two years to the day after Stacy was first reported missing and the night before another status hearing for Drew.

Members of the Westbrook Christian Church in Bolingbrook erected the plaque and tree outside of the Aquatic Center, at 200 Lindsey Lane in Bolingbrook.

I’m reminded of the Dr. Seuss tale about the Grinch who attempted to destroy Christmas by stealing the Christmas tree.

Flowers and a candle remain at the site of the theft

The plaque’s inscription was a simple one:

October 28, 2009: Today marks the second anniversary of the disappearance of Stacy Peterson.

Let’s try to remember this today and mark it in some way in our own lives. Her passing has meaning. Her absence is felt. Her family and friends mourn her, yet they have no closure and no justice.

On October 28, 2007, after ending a phone call with a friend, Stacy Ann Peterson was never seen nor heard from again. She’s lovingly and fondly remembered by her sister, family and friends as a wonderful, devoted mom, someone who loved to be with family, especially when gathering to celebrate a happy occasion, and someone who wouldn’t hesitate to help another, if needed. Stacy’s disappearance and ensuing story touched many people, including strangers who never knew or met her–strangers who devoted week after week to search for her, who became friends with her sister and family members, and vowed to keep looking for her until she was found.

Tuesday, October 27, the WE network show: “Secret Lives of Women” is airing an episode called “Loved & Controlled” which will feature three stories, one of them the Drew Peterson cases. Anna Doman and Cassandra Cales , will be talking about their sisters, Kathleen Savio and Stacy Peterson and what life was like living with Drew Peterson.

Groundwork is a domestic violence program of the Guardian Angel Community Services, a non-profit 501c (3) social service agency. Groundwork operates a 24-hour emergency shelter that provides a safe haven for victims. Last year the shelter provided almost eight thousand nights of shelter. Nearly a third of those nights were for children who had been impacted by domestic violence. Additionally, Groundwork operates a 24-hour hotline providing crisis intervention, safety planning, information and referrals. All services are offered to victims free of charge. Groundwork also offers legal advocacy as well as individual and group counseling to adults and children.

Peterson civil case can proceed

October 14, 2009 (CHICAGO) (WLS) — A Will County judge ruled Wednesday that the civil lawsuit against Drew Peterson can proceed.
The family of Peterson’s third wife Kathleen Savio filed a wrongful death lawsuit against Peterson.

The former Bolingbrook police officer is also charged in criminal court with murdering Savio.

Peterson’s attorney had asked that the judge issue a stay on the Savio family’s civil case pending the outcome of the criminal case.

“The judge didn’t stay the case, didn’t freeze the case. But he also said that Drew or indicated that Drew can take his Fifth Amendment privilege in answer to any question or any pleading,” said Joel Brodsky, Peterson’s attorney.

Savio’s death was originally ruled an accident, but the case was determined to be a homicide after Peterson’s fourth wife Stacy disappeared.

UPDATE 4:18 pm: It would now appear that Victoria Connolly and Lisa Ward have received cease and desist letters and that Joel Brodsky may have sent one to Ms. LeFort at an old address. We’re going to need to hold off on any further questions for a bit.

Since the news broke that Drew Peterson’s former step-daughter, Lisa Ward was speaking out and writing a book with allegations of abuse, there’s been plenty of discussion, here on the blog and elsewhere. We’ve wondered, why is she speaking up now? Why is she writing a book? Who is this author she is working with? Why is Drew’s lawyer hopping up and down and barking like a terrier?

Co-author, Michelle LeFort emailed us this morning with the answers to some of the questions we have been asking.

As for the “cease and desist” demand that Joel Brodsky announced he has issued against the author, she states that she, Vicki Connolly, and Lisa Ward, “have never been given a cease and desist letter-not one of us.” As to Joel Brodsky’s public claims that money is the motivating factor in coming forward, LeFort denies it. “We have made NO money as Mr. Brodsky, wonder attorney, might suggest and all hold down respectable jobs.”

LeFort does not believe that by speaking out, they are endangering the case against Drew Peterson.”We refuse to violate any testimony in this fiasco. Peterson needs stopped. We are trying to believe justice has the opportunity to prevail.”

I am Michelle LeFort. I’m sorry that we cannot comment on some of the questions that you raise in this blog and that the administrator asked me to comment on. I am happy to make a statement and had emailed as well.

Vicki (the correct spelling) had a car accident March 1, 1990 in Naperville unincorporated. She did NOT date Jeffrey Archer (personally verified by his wife, his parents and Vicki as well.) Jeffrey was killed, and had been having an affair, but it was with someone else and his wife knew about it. It could have been misconstrued to have been Kathleen Savio, but, again, it was not someone who had anything to do with this case according to his wife.

Lisa and Vicki have not come forward until now, because they are afraid. The legal team for Drew Peterson isn’t even the worst of it, but the sheer unabashed fear they faced for the duration of the time they spent with Drew. Money and Power are all I have seen in researching this case for nearly two years as HIS motive. We have waited to come forward for the very reason that Brodsky is proving all over the Internet-it comes down to name-calling. EVERYONE who says anything negative about Peterson is called a liar. Please tell me you see the antics. Are either of these men capable of rigorous honesty? They bash everyone. We really didn’t want to see our names smeared in the headlines with everyone else’s. We are human; we have feelings; we have fears; we are not backing down, just trying to do the right thing. We commend Cassandra, Anna and Sue, Neil, Steve … we understand what you go through and we’re sorry.

For women and children who have suffered domestic violence, the intrinsic fear they face is so deep that they rarely overcome it and move on without fearing their abuser.

Understand that Vicki and Lisa have undertaken the commitment to tell their story in a safe environment, a court of law first and then to detail that in books they are writing so that they don’t have to worry about Peterson/Brodsky (the incredible duo) trying to contaminate their lives. Facing this after years of trying to heal, they are still terrified that threats they received can be delivered. Their lives have been riddled by the murder of Kathleen Savio and the disappearance of Stacy Peterson in so many ways. Can you imagine if you had been married to Drew Peterson, what would it be like of a day? People calling you repeatedly wanting to know what he’s like. Being called to testify before the Grand Jury not once, but multiple times. The media hounding you for interviews, the spotlight shining on your life? Justice is their only concern. They have no monetary gain at this point and if a book deal is signed, they have it in place to donate a portion of the proceeds to the Domestic Violence Association of Illinois in the name of Stacy Peterson and Kathleen Savio. I have never witnessed two women who want nothing but justice and have a RIGHT to tell their story-like Vicki and Lisa, whom I have grown to love and respect. Feeling safe enough for them to do so will include a conviction in court and then their stories will be available. Please know that they must keep their families in mind when they make decisions regarding this case. As well, they have to testify at the trial and will not make their testimony a public affair until they have given that testimony to the appropriate source: THE JURY!

Not one cease and desist order was filed or letter seen, delivered or served at this point. My legal team has not received anything, including this so-called letter and Brodsky knows who they are and where to find them. As of Thursday, before the airing of Inside Edition, nothing had been delivered and I’m not interested in his ‘letter writing’ ability publicized by press releases sent out by Glenn Selig. When a judge tells me to cease and desist, I will comply. However, that will never happen, there would have had to have been something to base that order on and Brodsky has nothing. I am not legally bound to Brodsky OR Peterson, never have been, never will be. I was the first author that Glenn Selig approached to write Peterson’s story … I’ve seen what they have done to the other authors approached and I faced a similar situation, but did not want to make it public, because my intention to tell the story I found with decency and humanity is my only concern. There IS a story, one that will curl your toes, make you angry and fall in line to everything you have heard in this case. Testimony for the prosecution is what I want to hear … Don’t you? Vicki will not be heard before her testimony, because she is possibly the key witness for the prosecution. Vicki’s story is what you WILL want to hear, trust me on that.

The trial will start soon and we can all rest that justice will prevail and Kathleen Savio (severely abused by Drew Peterson according to her family and friends) and Stacy Peterson (who had been to Kathleen’s divorce attorney days before disappearing) will finally see that justice. I have followed your blog the duration and am familiar with what most of you have said. There were days I wished I could tell you what was going on, how things were moving forward, but it wasn’t the right time. We have kept a lid on things, because it was the right thing to do. October is Domestic Violence Awareness Month and Lisa chose to tell some of her story now, in reference to DVAM, in order to have women that face this situation possibly hear that getting out is possible and that you can heal. In time, all is possible. Please understand that this trial has cost everyone involved but Drew Peterson grave emotional tension, horrendous stress and fear.

Drew Peterson’s Former Step-Daughter Speaks Out Exclusively to INSIDE EDITION

“How does a father do that to a child?” Tears flow from a woman who says she suffered beatings and sexual abuse at the hands of her notorious former stepdad, Drew Peterson.

“I was beat with a belt, with my pants down.”

Peterson is now behind bars, charged with the murder of his third wife, Kathleen Savio. He’s pled not guilty.

“He looked…cold, heartless, exactly the same person that I’ve known my whole life,” says Ward of seeing Peterson, on TV, for the first time in years.

Lisa Ward was just 8 years old when her mom Vicky met and fell in love with Peterson in 1984. From day one, Lisa says she was terrified of Peterson, who was working as an undercover narcotics cop.

“He grabbed me back of head pushed and said whether I liked it or not he was going to marry my mother and he was going to be my father and I would respect him.”

She says her new step-dad was a control freak with a volatile temper. “You could just feel the tension throughout the house. You would just cringe, and hope that rage wasn’t coming back at you.”

And Lisa makes a shocking allegation about humiliating punishments she says continued into her early teens: “He would make me go into his room and pull down my pants and expose myself to him completely so I could be spanked bare bottom. The more I fought the worse it was.”

When her mom was hospitalized after a near-fatal car crash, she says Peterson did unspeakable things to her. She was only 14.

“He had told me that he missed my mother so much that he didn’t want to be without her. He asked me to come lay down with him. He had tried to touch me in an inappropriate way. I went in my room locked my door, and I thought to myself that can’t be happening,” she says tearfully.

After 10 years of marriage her mom and Peterson divorced. The next time Lisa saw Peterson was on the news.

“He thinks all women are targets,” says writer Michelle Lefort, who is currently working with Lisa on a book about her life with Peterson.

Drew Peterson’s attorney said Peterson strongly denies beating Lisa or sexually abusing her. He also said, “When people want to sell books they make allegations of sexual misconduct, especially against people who cannot respond.”

As for the murder charge against Peterson, Lisa has reached her own verdict: “Knowing the man, growing up with the man, I think he’s guilty.”

Drew Peterson is currently being held on $20 million bail. He’s due back in court at the end of October.

(PRNewsChannel) / Chicago, Ill. / Drew Peterson’s attorney says he warned the nationally syndicated program INSIDE EDITION that Peterson’s step-daughter Lisa Ward was lying about being abused by Peterson. He says he even gave the program a motive: money. But he says the program broadcast her false allegations anyway in a report that airs today.

“She is trying to sell her story. She is in fact writing a book,” says Brodsky. “She’s got every reason to lie. Drew categorically denies this allegation and to say he abused her in any way is patently false. This is not about journalism and getting to the truth. This is about telling a story to get ratings. Besides Drew and his family, the truth is the victim here.”

Brodsky also points out that the author Ward has found to tell her story backed out of a signed deal to write a book from his perspective. Brodsky says he sent Michelle LeFort and her attorney a Cease and Desist letter earlier this week after Ward appeared on the ABC program GOOD MORNING AMERICA. GMA did not contact Brodsky or anyone from the defense team for comment prior to the story airing.
