Drew Peterson is scheduled to appear in court today at 1:30 p.m. for the first hearing on a felony weapons charge. We’ll give you an update as soon as we know something.

In the meantime, here’s a new thread for discussion.

    They arent qualified to do this stuff.

    If the ISP isnt interested in that area, then why the need for so many toys and gadgets.

    Again, if they find something of interest, call the ISP and report it. The ISP has all the resources to get to it and see what it is.

    LetTheTruth, the way I look at it…I think it’s awesome that somebody is out looking with some kind of equipment. Roy may not be experienced enough…however, don’t forget…everyday fishermen happen upon things all the time. I am a firm believer, as stated too many times, that everyone should be searching their own properties and should they find something amiss…to call it in. By the way…I found an excellent analysis of the young missing man in Vermont whose body was found via airplane and /sonar. (he was a college student in VT…originally from NM) Here is the link. Apparently, this group is very experienced and it would be awesome if they could bring their stuff and help find Stacy too.

  5. i watched the geraldo interview…wow…Mr. Brodsky admits that in the picture the gun is actually legal and the barrell has not been altered.. that didn’t take place until a year ago… so what does that picture prove…exactly…

    Not surprised with Joel though he’s just being cheap and using the internet for his research and jury pool simulation!!

  7. picture only proves he used it as a duty weapon. if he altered it last year and never qualified with it then yes it was sooo illegal!! but still bbpd is responsible to ensure their officers are not carry illegal weapons or altering them once they are registered.
    wonder if they are just going to read the charges to him today and schedule another court date?

Mr. Brodsky absolutely messed up.. he admits his client didnt alter the gun until a year ago.. years and years after the picture in question was taken, therefore the picture proves absolutely nothing. Also… all the talk about all the years he has registered that gun and so on mean nothing.. because it wasnt an illegal weapon during that time.. according to Brodsky it didnt become an illegal weapon until his client altered it around a year ago…

    So why even bring those pictures up… they are completely irrelevant…smoke and mirrors…

    This is going to be interesting.
    now I’m curious when officers retire or leave the force that have an assult rifle for their swat duties do they have to turn it in or sell it?
    once they are not on the force the weapon is illegal fro them to have. wonder how many retired or xofficers still have their assualt rifles or how that works.

  10. i don’t know.. but if he altered the gun sometime around a year ago, and its been out of his hands for almost 7 months.. i dont understand Mr. Brodskys angle with saying that all this time LE knew he had the gun and that the pictures or videos mean anything…. Sounds like the gun couldnt have been illegal that long in Mr. Peterson’s possession… maybe he just forgot to register it with his boss.. that he had made the changes..that would suck for him…

    i think if they are illegal they have to turn them over.. or modify them back to legal length…

  11. yeah who knows JB might have a completely different story for the judge.

    my question is even is the ar-15 is modified back to legal length it is still illegal for a civilian to have so how are these weapons dealt with when the officer leaves the force. since it appears the officers are purchasing these weapons with their own monies and just registering them.

  12. that is a really good question..i guess he would have had to turn it in like he did the other duty weapons right..or sell it.. but since he bought it and it wasnt issued to him.. i dont know.. thats a really great question..

  15. Question about this alleged illegal weapon….am I understanding correctly that the reason it was illegal is b/c it is 3/8 of an inch too short? If so, what would be the advantage of shorting a gun by such a small amount?

  16. no…3/8 of an inch was the original rumor..it was released that it is actually 5 inches too short…

  17. Shortening a gun barrel is usually solely for the purpose of making it easier to carry as a concealed weapon.

    Prior to Drew getting all this heat on him for SP’s disappearance, once he was set to retire, he would have been able to apply and qualify for carrying a concealed weapon under the Act signed by President Bush in 2004.

    I don’t know why he would have carried that particular gun around as a concealed weapon, but, hey, when it comes to Drew Peterson, what do I know?

  19. There was so much stuttering and stupidness on that video that all i came up with is Geraldo is still Geraldo and Brodsky outed his client. All in all a good interview for LE.

  20. i dont think Mr. Peterson could have owned that gun once he retired..could he… modified or not.. or am i confusing myself…

    someone mentioned once in a conversation that those guns..when modified become more dangerous..not just because they are concealead easier but because they do more damage.. does anyone here have enough gun knowledge to know if that is true or not…

  22. Okay, here’s a snippet from something I found:

    Barrel Length vs. Muzzle Velocity

    It is a usually accepted fact that gun barrels of different lengths will produce different muzzle velocities with the same load. Generally, the longer the gun barrel, the higher the velocity…at least up to a point. Only a few decades ago the common length of center fire rifle barrels ranged from 26″ to 30″. These rifles were heavy and unwieldy to carry around in the field all day. Today, the more common lengths for sporting rifles are in the range of 22″ to 24″, resulting in a lighter and more portable firearm. With this change many shooters want to know just how much velocity is lost in switching to the shorter barrels or how much velocity gain can be achieved in a longer barrel.

  31. Mr. Brodsky seems to feel he got the better of Geraldo because of Geraldos lack of gun knowledge.. but i think maybe Geraldo got the better of Mr. Brodsky because he got him to admit that gun was LEGAL in the picture which makes it completely irrelevant and worthless…

    i just don’t understand why all the smoke and mirrors about registering it all these years..and the pictures and the videos… if the gun was legal at the time.. then what he is claiming doesnt mean anything…

    he’s going to have to show something last year.. between the time he altered the gun..to November when the gun was taken.. that shows that he alerted BBPD of the change in the weapon.. even IF he had registered it with them before..

    And something interesting they said, LEO’s are exempt from barrel length if it is used in an official capacity.

    So we need to read the law on this.

  38. the problem is that Mr. Peterson had 2 guns given to him for official use with the SWAT team..and this isnt one of them.. and if he made changes to the gun i’m pretty sure it would have needed to be reinspected.. just because Mr. Peterson carried it 6 years before he altered it to protect a celebrity on duty doesnt mean that he could decide it was an official weapon…

    Seems to me like Mr. Brodsky will have to do alot of backpedalling now.. the truth is that if it were as black and white as he claims it is..he would have already produced paperwork showing Mr. Peterson properly registered the gun… and not showing a 6 year old picture of the gun before the alterations….

    But Lynwood connection … and I’m just pulling from an article: which included a copy of a National Inquirer article on the Peterson case, a map of a cemetary in Lynwood, IL (which is where the Inquirer speculated that Stacy’s body has been dumped), and a rambling letter that among other things, told Sharon that “this is where you can find her.”

  44. If, and I say if, I can find that article law about the gun length, then it might fall on the Chief to produce his evidence that Drew didn’t register it with the department.

    From what I have read so far, and its a very small amount, most LE’s officer are exempt from most of these laws if they are used in an official capacity.

    So if Drew had the weapon for the purpose of being a SWAT officer, then he would legally be right. He would be able to alter it, and fall under the exemption of the law.

    I’m just amazed after watching that video. How and why would Brodsky get so flustered as to admit that DP altered that barrel about a year ago? What in the heck was he thinking when he admitted that? So, his defense is that DP used that weapon during the course of his duty, even though BBPD says it has no paperwork, and as long as they knew about it, it was okay. BUT, he forgot one little thing. It WAS okay, technically, at the time because it was a LEGAL weapon.

    I’ve asked my husband this question 6x already and he’s tired of me asking. I asked if he can “legally” own an illegal weapon, even though he is an officer, and he said NO.

    I guess the laws are different for DP.

  51. yes I think coppers post are pretty informative. According to copper if drew has the proper paper work then he will be ok, if not and bbpd doesn’t have any paper work then drew will IMO be found guilty.

    Brodsky said he advised Drew not to talk after this weapons arrest. As you can see, Drew is talking. He did make remarks about losing his 22 year old to the stress of the situation.

    Drew is a run-away client. He’s a lawyer’s nightmare, I would venture to say.

  64. Noway, Im not making excuses for his humor, but I know its very common humor amongst cops. Sometimes the stuff I hear, I blush, and its next to impossible to get me to blush.

    Its a different culture. And I do believe its a defense mechinism.

    Mr. Brodsky is seen on a tape, bantering back and forth with Geraldo Rivera, discussing the weapon that is the subject of DP’s arrest.

    In that tape, Mr. Brodsky openly admits that the weapon was altered within the last year by his client.

    The weapon in the picture with John Travolta, even if it is the weapon in question, regardless of paperwork or not, was legal, then, at the time he was carrying it. Now, it is illegal by law.

    Yet, now Mr. Brodsky is saying that, as a police officer, DP is exempt from being in violation of the law.

    What are the true facts here regarding DP and this weapon. Does he get a pass or not solely because he’s a police officer (active when it was confiscated), or was he clearly in violation of the law?

  67. Iknow…thats according to the BPPD, we will have to see what they have as far as paperwork.

    And again, it could be a loophole. Was SWAT a different entity than the BPPD, meaning was it made up of many departments. If that is the case, is that where the gun was registered and qualified?

I’ll just weigh in to say that earlier Brodsky stated that when Drew had purchased the gun it was in the state it is now and that he had not altered it. Now, I see in the Geraldo interview he says that Drew shortened the barrel a year ago.

    He really doesn’t hold up well under a direct attck does he? A couple minutes with Geraldo and he was stuttering and misspeaking and then trying to back pedal. He was really flustered.

  70. Well Drew is an adult, if he can’t control himself he should seek help. I am sure any normal cop would reconize the difference of being in a group of cops and making remarks like that and being in front of the nation and making remarks like that. The guy is mentaly ill and he needs help.

  79. yes most new cells have gps functions and you have the option to turn them on. there is a package parents can buy to track their kids dk if that was on the phone or not. if not there is no way drew could track her without installing that package.

    The gun, now that is another story, and one that is going to be interesting to follow and see what the real deal is.

    No seriously, it shows us a lot about his character. While he’s using his PR to show himself as father of the year. He is activley pursuing yet another young girl while still a married man with a missing wife.

    It’s a terrible decision to make if he feels that he is being tried by the public opinion.

    It doesn’t mean he’s going to touch that kid, but if he’s worried at all about public opinion it’s probably the stupidest thing he could do.

    Let, to some of us, me included, it just further portrays Drew as being the egotictical psychopath he appears to be. I’m sorry, but why is a 54 year old man trying to hook up with another VERY young woman? At least she is legal age. That’s the only positive I can see here.

    LTTBF – this reminds me of something that stood out for me when DP was on Larry King Live.

    He was doing his usual bash-Stacy routine, when he said that “Stacy loves male attention.”

    Duh, WTH? Is that why women get their hair done a certain way, nails done, pedicures, facials, tanning salons…….

    LOL, guess she was supposed to pack it all up once she married DP. Never, ever again to feel special if another man looked at her.

    But why should the focus strictly be on Drew? Isnt that what an investigation is all about, looking at every angle?

    We have so many characters with this case, that anyone of them, if we tried, Im sure we could make a case that they might have had something to do with her disappearance.

  119. LTTBF – I hate to get into the former board stuff, because it does tend to start up a lot of other issues.

    But, to respectfully respond to your post, I’ll say a little of my feelings about that.

    I think it was a valid, legitimate attempt by supporters of Stacy to find ways to bring her home. When you get so many personalities involved, it just can’t work, at least the way they had it set up. It happens here sometimes. Most of us respect the other’s opinions, whether we all agree or not. But, there were a bunch of mouthes over there that needed to be shut up! I occasionally pm’d my feelings about certain posts when I felt it insulted my intelligence.

    As far as the money issue, if they’re doing something wayward, time will tell and it will be handled by the appropriate authorities. There’s bad apples in any situation. Clergy, police, teachers, coaches, and I could go on.

    Any more than that, again, since I’m sitting on my prissy chair behind this keyboard and they’re doing a whole lot more than me, I’m remaining supportive, and silent.

    As far as focusing on someone else, LE is required to turn over exculpating evidence to the defense too. So, if they’re finding something that would help Drew, like it or now, we know that must also come out. That will be for the jury to decide.

    I’m thinkin’ it’s not looking too good for DP. I can’t stand the man, and he has himself to blame for my feelings about that.

    IMO, Once DP started his media appearances, that snowballed into what it is now. Once Brodsky got on board, who, I believe, was looking for his 15 minutes of fame, it just grew and grew.

    Stebic’s attorney is not a publicity hunting misfit. He is not trying his client’s case in public, and he’s acting in a dignified, respectable way, IMO. It appears that Stebic’s attorney has gotten his point across to his client also. That is, “keep your mouth shut and let me do the talking only.”

    Brodsky has an uncontrollable client who can’t keep his mouth shut. I really think the guy’s head is messed up. Brodsky is just going along for the ride.

On that same interview, he said one of the reasons he took the case was so the “public” could see what a good attorney he was, then laughed and said “or bad, I suppose.” He made reference to the sensationalism of the case, but I don’t remember his exact wording about that. Bottom line, he wanted to be in the media too, and get his name out there for other high profile clients to see.

  155. freedom – Drew was on The Today show, I believe, within days, if not a couple of weeks, of SP’s disappearance, endearing himself to the public, explaining his wife’s menstrual reactions. That just started the ball rolling and it went from there.

    Honestly, when you think about it, most people were swayed as I was. A few have distaste for SP as well, but, I believe, when it all comes down to it, if he’s shown to be the evil man he’s portrayed as being, he’s not going to get a pass.

    Stacy is not without fault, yes, I’ll admit, but again, him taking as his love interest a 17 year old, with all his years of experience, cuts him off at the knees for me, and I can rationalize my feelings about how Stacy got the shaft the day she met him. Right or wrong!

  164. Before I sign off, I had to read the last couple of posts, one of which was Rescue’s about Drew and a 17 year old love interest. If, for example Drew had been one of her teachers in high school and this had been going on, do you not think for a moment he would have been fired by the Board of Education? Absolutely he would have. It’s beyond me how it was condoned by BBPD, even though he said he got “permission” to date her. My feelings on that is that he didn’t even ask until she had turned 17, because he supposedly starting seeing her when she was 16. The guy is a pervert in my opinion. Sorry.

    I beleive that there is some truth in what stacy told the pastor.
    at this point I feel that stacy was more involved then just saw drew coming in after the fact. I could even believe that stacy and her family actually killed kathleen and drew covered it up.
    I could also believe that Stacy made up what she said to the pastor to get drew out of her life.
    Since nothing has been proven concerning Kathleen’s death and no suspect has been named by LE I really question what the pastor stated.

At the end of the day, when you put this all together, that Stacy withheld her information for 3 years (KS died in 2004), and what there is to know now about DP, the jury is going to do the same thing we do. Take sides. However, once they have in their hands evidence of SP’s murder, DP’s and JB videos played for them with follow-ups from the prosecution, people coming in and testifying that he threatened them with death, and other pieces of evidence they can touch and look at, it might just compel them to send him away. Regardless of whether it’s shown that she, at the very least, knew about KS’s fate at the hands of DP.

    Now, KS, that’s a whole ‘nother ballgame, and I won’t even begin to say I would know what LE is going to do with that.

    *** An AR-15 is not an illegal weapon. It can be purchased and owned by any legal FOID holder that has the money. They come in many, many variations and have a multitude od accessories avaialable for them. Probobly more accessories than any other single firearm. It is esentially the civilian model of the M-16, but not “supposeded to be capable of muliple shot bursts or fully automatic fire.

    *** A “machine gun” is a weapon which repeatedly fires rounds with a single pull and holding back of the trigger.

    *** Yes many times shortening of barrels (such as on shotguns) is done for concealment. This shortening is usually done in conjunction with cutting off the long shoulder stock into a somewhat “pistol-grip”. A real hitman’s joy. But in the case of a firearm like the AR in question, it is a tactical modification which allows someone like an entry team member to move thru tight quarters like hallways, doorways (etc) and be able to direct their firearms barrel from side-to-side without it being obstructed by hitting walls or door jambs.

    *** I would not say accuracy is out the window when shortening a barrel on something like an AR. IMO a proficient shooter could make swiss cheese out of a paperplate at 100 yards. Longer barrel versions of ARs & M-16s can shoot very, very well to 300 yards with open sights.

    *** If indeed Drew shortened the barrel that this gun originally came equipped with he would need several things. 1. Knowledge. 2. Access to a lathe to cut the barrel to length and also, correctly thread the barrel end to accept a flash suppressor or silincer. Threading would not be required, but it looks like a suppressor is on there. Or, he could have purchased a shortened barrel to install.

    *** Why say Drew shortened it himself? There is always debate in regards to where to start measuring the barrels actual length. “Your honor, it seems that there has simply been an innocent mistake as to where the measurement should be taken fro. My client is certainly not an armorer or gunsmith and was only doing what he believed to be what he thought was right. He has never had a single firearms infraction or incident – ever.”

    i.e. slap on the wrist handed out. ( case law?)

    *** The relationship into Matuska will certaily continue to be scrutinized by LE because it could be a motive. Motive is everything in crime and prosecution.

    For the record for those of you furiuos with funds and begging equipment…ISP is NOT SEARCHING ANYWHERE anymore(Nor do they OWN and ROV)…it’s just friends and family. Unless and until a credible tip comes, they are DONE, watch the video with Craig Wall again, he puts it out there. If this makes you angry? imagine how family and friends feel? Ask them why, bad mouth them, call them each week! and good luck with that.

    It is sad that I feel the need to defend searching for Stacy on a blog, but sadder I suppose that people can tear apart the people who are giving unconditionally of their efforts.

    Drew Peterson purchased the weapon, but it had a barrel length that is considered illegal by law.

    He altered the length of the barrel to conform to law and/or department regulations.

    One year ago, while still an active p.o., he returned the barrel to it’s original length, now illegal again.

    Brodsky’s latest explanation is that Peterson, no matter what is determined as far as the legality of the weapon is concerned, is not in violation of any law because he was an active p.o. at the time of confiscation, and he’s allowed to have any kind of gun he wants, legal or illegal.

    Do I have this right?

    Shortening a barrels length DOES NOT make the necessary internal parts appear in the receiver/trigger group, or the necessary machining of the existing receiver that are required for fully automatic fire.

    Maybe it was my post that was confusing. I was pointing out that Brodsky had said two conflicting things at different points about the gun.

    A. When Drew bought the gun it already had the short barrel.

    B. When Drew bought the gun it had a standard barrel. He shortened the barrel himself a year ago.

    No, I don’t think that way. First of all, the GJ was scheduled to run through the end of May anyway, so they have nothing to lose by waiting. Once he’s charged, it’s to go to trial within 120 days, and the defense would have to receive all of LE’s information/evidence findings.

    Maybe they found her phone, or the missing laptop. Wouldn’t it make sense that they would continue to search for her body, or hope that it would surface in the Spring? As it is, Brodsky/Peterson are totally clueless as to what LE has or doesn’t have. Tactically, that makes sense to me for the prosecution!!!!

  256. To the best of my knowledge there are no land or water searches being conducted on any routine basis to search for Stacy Peterson, Lisa Stebic, Brad Olsen, John Spira or Scott Arcaro. All these people have been missing for more than 6 months and if the search efforts for Stacy could render anything that would help any of these families have closure…it would be a just reward.

    This is not to say their cases are not going forward or being investigated, just not physical land or water searching. This is a typical and a normal thing with cases that are 6+ months old.

    I never said the ISP are not working with search efforts? they are, just not conducting any routine searching of their own any longer.

    What family member said ISP is still searching? do you remember when you heard this? other than GJ comments, it’s been a while since family has commented on anything..I think…but I do not get to keep up on everything.

    Sure hope something is addressed on the gun charge and not dragged on and on like I suspect it will be…Joel assuming a picture would make this go away…priceless.

    I think it’s possible ISP was able to pinpoint Drew’s location at the time the call was made from Stacy’s phone to Drew’s phone. At that time, Tom Morphey was sitting in the cafe with Drew’s phone and instructed not to answer it if it rang.

    Maybe Drew tossed evidence – the laptop computer, clothing, cell phone, or other evidence into the canal, and this is what ISP was searching for.

    Noway – I don’t know how to answer that. There have been many bodies dumped in that Canal.

    Years ago, a man we knew had a sister who disappeared and was murdered. Her body was found in that Canal.

    During the night hours, who knows what goes on! Cars that the owners “want to be stolen” end up there, heaven knows what else. It’s a bad, bad place. Freddy Kruger kind of place!

Throwing small items into the Canal is not that far fetched for him. What else would he have done with the stuff?

    Remember, he wasn’t planning on being the butthead of the month, on national tv. He was acting spontaneously and as quickly as he could to get rid of evidence.

    When all this stuff first started, Peterson was represented by an attorney by the name of Fred Morelli. I know of this attorney because he was a referring attorney of cases handled by the lawyers I previously worked for.

    He spoke for DP in the beginning, and that’s when DP shut up. If you guys will think about it, Morelli is also the last name of the ex-BBPD partner of DP. That’s who I think is in the pic with him and Travolta. I don’t know how and if these “Morellis” are related, but I would assume so.

    Then, DP went on The Today Show, and that’s where he started hawking about a lawyer calling him to represent him. I wonder what happened to Attorney Fred Morelli?

    He had a “real” lawyer in the beginning and I think the lawyer “fired” him after he ran off with his mouth and started losing control of him. I’d like to know the reasons behind that.

    I was gone for a bit. I had a handyman in to remove some structural oddities in the house and help fix some bifold closet doors and he just left. Now my house has some gaping holes in it, the bifold doors close but one is an inch shorter than the other.     The state also has two weeks to respond to a motion by Peterson’s attorneys to modify their client’s bond, to allow him to leave Illinois while out on bail. The state will also have a chance to respond to subpoenas Peterson’s attorney issued to the Bolingbrook Police Department seeking their client’s weapon records.

    Attorneys for Drew Peterson filed a motion in Will County Court on Friday to dismiss the felony unlawful use of a weapon charge filed last week against the former Bolingbrook police sergeant, saying that as a police officer he was exempt from the state’s weapon laws.

    Will County Judge Sarah Jones gave the state 14 days to respond. A preliminary hearing has been scheduled for June 30.

    Friday marked Peterson’s first court appearance since his arrest last week. Authorities said the charge stemmed from Peterson’s ownership of an assault rifle with a barrel nearly five inches shorter than allowed by law.

    Peterson and his attorneys, Joel Brodsky and Andrew Abood, claim the gun was registered with the Bolingbrook police for Peterson’s use as a member of the department’s SWAT team. But the Will County State’s attorney’s office contends the gun was privately owned by Peterson, and Bolingbrook police officials have said the department had no knowledge of the weapon

  340. I don’t know one way or the other if the charge will be dropped. We’ll just have to wait for the “evidence” from both sides.

    What I do know is that Brodsky is just not a credible, respectable, dependable advocate for his client. If I had any inclination to even remotely think DP was not guilty of the crimes he’s being investigated for, I would be furious with him as an attorney.

    The way it is now, knowing how I feel about DP, I’m glad he’s DP’s attorney. He stinks.
