  3. Drew Peterson’s attorneys file motion to dismiss weapons charge

    Attorneys for Drew Peterson filed a motion in Will County Court on Friday to dismiss the felony unlawful use of a weapon charge filed last week against the former Bolingbrook police sergeant, saying that as a police officer he was exempt from the state’s weapon laws.

    Will County Judge Sarah Jones gave the state 14 days to respond. A preliminary hearing has been scheduled for June 30.

    Friday marked Peterson’s first court appearance since his arrest last week. Authorities said the charge stemmed from Peterson’s ownership of an assault rifle with a barrel nearly five inches shorter than allowed by law.

    Peterson and his attorneys, Joel Brodsky and Andrew Abood, claim the gun was registered with the Bolingbrook police for Peterson’s use as a member of the department’s SWAT team. But the Will County State’s attorney’s office contends the gun was privately owned by Peterson, and Bolingbrook police officials have said the department had no knowledge of the weapon.

    In November, state police investigators probing the Oct. 28 disappearance of Peterson’s fourth wife, Stacy, seized his vehicles, computers and 11 firearms from the couples’ Bolingbrook home, including the weapon at the center of the felony case, a Colt model Sporter Lightweight, 223 Remington rifle.

    Peterson, who has been named a suspect in his wife’s disappearance, retired from the department in mid-November after a 30-year career. Authorities are also re-examining the mysterious 2004 drowning death of Peterson’s ex-wife, Kathleen Savio. In February, Will County State’s Atty. James Glasgow declared her death a homicide.

    Peterson has steadfastly denied any involvement in his wife’s disappearance or in Savio’s death, and has not been charged in connection with either investigation.

    The state also has two weeks to respond to a motion by Peterson’s attorneys to modify their client’s bond, to allow him to leave Illinois while out on bail. The state will also have a chance to respond to subpoenas Peterson’s attorney issued to the Bolingbrook Police Department seeking their client’s weapon records.

  7. In about half an hour, the local news will start airing. Ch’s. 2, 5 and 7. I’ll be watching to see if they have any of the coverage about DP’s appearance. Didn’t think he was going to be showing up today. It’ll be interesting to see if he yaps it up today.

    Also, I will be curious to see if Brodsky gets his mug on NG.

    Sanchez-Orellana had no identification on her when her charred body was found, and dental records entered into a national database didn’t lead to a match at first.

    It was all a mystery until October, when a niece in Texas found an online posting on the “Doe Network,” a missings persons site that described the unidentified victim and a distinctive Mandarin-style burgundy jacket she had been wearing, along with a gold ring inscribed with the initials “O.M.O.” Investigators later determined that the initials were those of her husband, Oscar Manuel Orellana, Dudek said.

    A lawyer was booted from the Cook County Criminal Courts Building today after attempting to foist his own music CD on R. Kelly in the courtroom where his trial is taking place.

  28. Hi she, I was just thinking the same thing. In all the other hiprofile cases, I don’t think I ever heard of a real attorney answering online questions about their clients case.

    Maybe I’m wrong but I think it’s not good practice. His PIs could get the same thing accomplished logging in at a few sites for a few days. Oh yeah, they’re looking for Stacy.

    That’s just the forum owner’s opinion and based on nothing. In my opinion, he is a bigger boob than Brodsky.

    He stated this morning that Drew had yet to be arrested or charged with anything. He is an ignorant person.

  33. I was just reading over your comments about JB posting on a blog.

    Just remember, this is the same guy that goes on tv news program after tv news program and discusses his client, ad nauseum, and “allows” his client to do so, all against the thinking of other attorneys following the Peterson matter. Everything about Brodsky is against defense attorneys’ mainstream way of thinking and acting. Brodsky defends it with his baloney about “white noise.”

    So, this blogging stuff is just another spectacle he’s creating. That’s why DP picked him as an attorney. They think and act alike. That I got from reading it straight from the horse’s mouth.

Couric asks if there are any “boy scout” cops in Chicago. Herrera replies he doesn’t know, there might be, but this is Chicago, not Podunk, Iowa
    This is the type of desperation interview that is going to cause a load of collateral damage. It also reeks of a plea deal that fell through. Someone else made a deal on something?

    I believe there is more visual flare, so for warfare they put the suppressor on to cut what the enemy might see of them.

    When Geraldo kept saying it was sawed off it finally made JB come out with “he exchanged the barrels.” within the last year. I wonder if that was on purpose to get him to clarify.

  54. You know, when I make fun of this spelling issue, I do get kind of way off on it.

    But, in order to become a police officer nowadays, at least two years of college is required. Some departments required a Bachelor’s Degree. That is so that a young officer is capable of knowing how to spell the street names he puts down on his reports. (Just kidding)

    An attorney has to write tons and tons of briefs and other documents, so a basic knowledge of the English language would be helpful.

    I’m not trying to put anyone down about spelling. Lord knows, I’ve had a few blunders myself, and I sometimes type too fast and don’t proof read my stuff, but I have no tolerance for an educated person, such as Brodsky, and a police sergeant who must, among other things, pass written exams for promotion, who can’t even spell the word “riding.”

    Now, if neither one of them made up that text message, well, then just ignore this post and, poof, it will go away! But, I’ve still made my point.

    Now drew very well may have sent that from nextel’s website in Sept to stacy and she saved it dk.
    If drew sent it from a home computer the forensics would show that and they probably checked his work computer also.
    So it’s more than likely that someone else sent that message and used the nextel site so if drew did find it he would not know who it came from.
    I think many forget when they speak of drew and the class of people he hangs with him that stacy and even cassandra and daddy cales were part of that crew. so it’s not unlikely someone she was flirting with sent that message and can’t spell either.

    Honestly? I didn’t know the trial was ready to begin. I’ve been so overloaded with work that I haven’t listened to the local news….and I always listen to satellite in my car during the day. I will say one thing, however, he is obviously very guilty and I don’t think this trial could possibly be more than a few days. His wife and baby was beautiful. It’s a terrible tragedy. I did hear they want to try and move the case but I don’t see that happening since they are picking jury’s.

    I find that really odd that the same comment is used and don’t buy this article and it’s statements as direct quotes at this time.
    But I agree that is soo freakin sick and these types of statements give the public much outrage and rightfully so. But if they are fabricated for the purpose of some book or media sensation, they need to be factual.

Lead in- I am baffled but then nothing surprises me with this guy, Drew Peterson, the husband of SP, KS etc etc “What is the connection between Drew & John Travolta?” Paraphrased; Mod asked if it was just a publicity stunt, as the officer next to him was DPs SWAT commander and would have more information about the gun. JB admitted yes of course its for publicity. But they took off the 5″ suppressor before they photographed it and it was legal and drew qualified with it. The supervisor that Drew qualified the weapon with for many years will be called to testify and “he wouldn’t risk his pension by lying,” (JB).
    You would really call JT to testify? (mod) Well if he could testify to the authenticity of the picture maybe he would be helpful . . . blah blah blah (JB)

  74. lavanda is there a laptop missing? This is kinda like the cell phone missing lots of conflicting info.
    I had read back a few months ago, have no clue where and to lazy to look, that one of the later search warrant stated missing laptop and by that the wording meant laptop not recovered on the first warrants. I believe this “missing” laptop was obtained at the time of that search and I’m thinking it was in Jan. I have no clue if this is true or if there truly is a laptop missing.

  106. Hi everone, first time posting. I have been watching this case since I became addicted to it, back in November of 2007. I have been to all the boards, looking for info, and yes the FSP one, posted a couple of times, now that it is gone, I look at other boards that might have information, incl. the usual bickering, and all I can tell you all…is that MY HEAD is SPINNING!!! I have gotton to know certain posters by their posts, I have gotten to know the Pro Drew, and Pro Stacy, and vs versa…and my HEAD is still SPINNING. Honestly? All I want to see is this case come to justice. I have my own opionion about the players. I don’t think this is a For Drew or For stacy, this is about a young woman missing, and about her very disturbing husband emerging for all to see. Something is very very wrong with all this.
    I do have to say that this site is my favorite one.

    I will continue to read, and wait for the day that whatever justice is served

    The gun was only recently 7-8 month ago modified by Drew. Which goes against what JB answered me that it came that way. It was exchanged to the illegal barrel length. Illegal is determined by the standard length w/o suppressor or silencer extention. The chief said the ‘modified’ gun was not examined since modified.

  142. Good question. Does he have family out of state? That might make the judge sway his way. To put the kids in a normal atmosphere with a sister in wisconsin, ie for some time out of the limelight, just doing kids things, riding bikes, etc. might be enough to get judge to agree.

    Especially if Drew can get across any intimidation inuendos made by Sharon or having to keep the kids in the backyard or indoors 24/7 due to media or gawkers. Not good for the kids and I think the courts try to do whats best for kids.

    As long as I know what town in Wisconsin to avoid.

    Being a pilot myself, maybe someone in the know can verify credentials.
    Mr Peterson may be indeed doing something outside the law, depending on what FAA license he holds, and whether this mistress is, in fact, a student pilot.
    Generally, an ultralight is a single-person aircraft. The FAA makes an exception to allow two-place (two-person) aircraft and flight, but there are certain restrictions accompanying the exception. Most importantly, the pilot must be a certified instructor by one of the ultralight regulatory organizations (ASC, EAA, or USUA), and the passenger must be a student pilot. More flight experience, training, and testing are required in order to become an instructor (to be able to carry student passengers)
    I am not here to nitpick the suspect, but if in fact this gentleman is operating outside the laws, it indeed shows a blatant lack of respect for the very laws he, as a law enforcement officer especially, has sworn to uphold.
    IMO this does, in fact, speak volumes.

    ..just because Mr. Peterson carried the gun with him one day doesnt make it a duty weapon.. in order for it to be a duty weapon they have said it has to be registered and approved by the weapons guy… thats like saying if i bring my dog to work hes a police dog… geographic location does not make it official…

    Well, there are quite a few on here that would give you an argument on that, but I’m not one of them.

    I’m on a bit of a roll here
    From what I gathered, and I might be wrong, but
    Mr Peterson doesn’t hold a instructor rating therefore is not legally entitled to carry a passenger.
    That being said, even if he does, the young lass he took up for a ride is not considered a student pilot, keep in mind this stuff can be fudged by giving her a log book or something. Ultralight laws are pretty lax in that the pilots do not have to pass a medical exam, nor does the aircraft have to adhere to the stringent FAA mechanical and other inspections.

    That being said, his aircraft is indeed a two seater, therefore is capable of carrying around 150lbs extra, plus the pilot. It was admitted that he took his ladyfriend for a flight on labor day (sic).
    I am guessing that the plane has a larger carrying capacity than speculated earlier by the pundits and bloggers.
    Does anyone know what the flight conditions were in the area on Oct 28/07? Were they VFR?
    My available historical data does not go back that far.

    A 503 Rotax on an airframe that size is more than capable of bearing the gross weight of 2 normal passengers.
    The repairman cert is not a big deal – it just gives an owner of an aircraft in this category the right to make repairs/inspections on his/her own aircraft. This aircraft is hardly sophisticated, the repariman certification usually is obtained on a weekend seminar.

    It is noted that he completed a weight shifting course, this course is usually only taken by ultralight pilots -the planes are lighter therefore the shifting of the weight of the 200lb pilot would indeed have an effect on the flight charachteristics.

    One of the current homeowners told the Tribune on Friday that state police came to take the tub last week, but declined to comment further. A spokesman for the Will County state’s attorney’s office confirmed her information and said the tub was in storage.

    No, the law states no passengers on an Ultralight.
    There are several reasons.
    But you are sorta right, the size and weight does play a role, however since the FAA licensing requirements are lax, and the medical evaluations for the pilots are nil, and the aircraft does not require maintenance by a certified aircraft mechanic (A&P)…well it boils down to liability, really. Even if the aircraft is more than capable of carrying the weight and has lots of horsepower, it still cannot legally be used for commercial purposes and/or taking passengers.

    My concern is twofold.
    One, the blatant disregard for rules/laws. The attitude seen time and again by the same ole, same ole, types. Those that feel rules are for everyone else, those amongst us that feel they live under a separate judicial system.
    Two, something has always been hinky about the airport/aircraft connection to this case. I just recently realized that the suspect may very well have been at his airfield that day, and that his aircraft is more than capable of taking up 150lbs or so. And the suspect also as “weight shifting” training.

    I’m just saying.

    Ahh I get it, for the life of me I can never figure out why people do that. Kids, I suppose.
    No biggie.
    Anyhow, an ultralight could bot get out very far
    over open water. More rules.
    The thing about ultralights is they can fly “under the radar” so to speak. They do not have transponders so they cannot be tracked, they are small and relatively quiet and can fly quite low.
    Not to mention that many can land off-airport, like in a farmer’s field or on a dirt road. They don’t need a lot of room to take off or land.

  179. Rescue, I think that is the first time I have heard of the police actually taking a bathtub. I’ve seen mattresses, but never bathtubs.

    Can you imagine being the new owner of that home and the ISP comes knocking wanting your bathtub?

    Not at all
    But It would be too risky as aircraft flying over open water that does not carry the necessary survival equipment. The pilot cannot lose sight of shore, by law, if he has an engine failure, be able to glide onto a landing are on land…lol
    I think if an Ultralight was spotted “way out there” it would be reported.

    1. What possible evidence could there be left in that bathtub at this point?

    2. If you were the current owner of the house, would you ever be able to lie back and relax in that tub knowing some poor woman had been slumped in it, dead? More power to them, but I couldn’t have done it.

  193. scott – I moved into a house where a woman had died and not been discovered for a while. A nosy neighbor made sure to tell me as I was moving in. I didn’t know exactly at what location she died and the place had been renovated so….I just didn’t tell the kids.

  195. juror – When I watched that video, I felt very comfortable thinking Brodsky was flustered and uninformed as to just what was going on with that gun. But, then, sometimes, there’s so many posts flying back and forth here, that, once again, I get confused as to what is actually going on and what are summations from different people.

    I THINK DP bought that gun and it was not equipped with a legal barrel, he altered it to conform to the legal regulations required by his PD, he then altered it again to it’s original state, which is the state it was in when confiscated.

    Okay, so now he’s not in compliance with the law because he’s in possession of an illegal weapon, whether he’s the police or not. Except Brodsky says even though it’s not a legal gun, it’s okay because he’s the police (or, at least was active at the time of its confiscation).

    That’s where I was the last time I tried to figure this whole gun thing out, but, hey, who the heck knows now what it is or isn’t???

    Which now leads me to these questions. Was he required to purchase his own weapon to be on a SWAT team? If so, why weren’t they department issued? Did he have the option of using a department issued weapon. If he chose not to, why not?

    Can you imagine, buying the home, going to the closing, and on your first day in the house a neighbor stops by to say hello and introduce themselves and mentions something evil happened in the home?

  204. I would have remodeled the whole bathroom altogether. The bath was a weird size too small for a jacuzzi, etc.

    I think the KS killer tried to catch her sleeping and disable her toward the bathroon where the drowning was done. A fight ensued and a drowning in the toilet by brut force was necessary to get deed done. Then the cleaning and preparing the crime scene to stage the murder was necessary. Lividity and victims SOP for bathing, usual bath time, covering the head wound, etc

  205. I think the ONLY reason to remove the tub is to admit it into evidence for trial, or to show the grand jury. I believe the removal of the tub is a big red flag telling us an arrest is eminent.

    In California, real-estate agents are required by law to disclose to prospective buyers if something had happened in the home.
