    Drew Peterson lost his attempt Wednesday to have two felony weapons charges dismissed, but his attorneys said they’re confident he’ll win when the case goes to trial.

    A Will County judge rejected an argument by Peterson’s attorneys that federal law allows the retired Bolingbrook police officer to own the assault rifle that prompted his arrest.

    The ruling by Judge Richard Schoenstedt clears the way for Peterson — who has been labeled a suspect in his fourth wife’s 2007 disappearance — to stand trial later this year on charges he possessed an AR-15 assault rifle with an illegally short barrel.

    Peterson, 54, faces a maximum five-year prison term if convicted.

    “The prosecution is continuing, so it’s not a total victory,” defense attorney Joel Brodsky said, but he added: “There are many positive aspects to this [ruling].”

    Schoenstedt could set a trial date when Peterson next appears in court Aug. 28.

    Prosecutors praised the ruling, saying they’re eager to take the case to trial.

    “We’re just pleased we can move forward with the case,” said Charles Pelkie, a spokesman for Will County State’s Attorney James Glasgow.

    The weapons charges are the only ones filed against Peterson, whose fourth wife, Stacy, disappeared last October.

    Authorities have also reopened their investigation into the 2004 drowning death of Peterson’s third wife, Kathleen Savio. Her death, initially ruled an accident, was reclassified a murder after Stacy Peterson’s disappearance.

    State Police seized the assault rifle and other weapons last November during a search of Peterson’s Bolingbrook home. It wasn’t until May that prosecutors filed the first weapons charge against him, alleging the barrel of the AR-15 is shorter than the 16-inch limit set by state law. They added a second charge in July, contending Peterson transferred the illegal weapon to his adult son Stephen.

    Peterson’s attorneys, though, argued the gun charges should be dismissed because a 2004 federal law allows police officers nationwide to own and carry weapons, regardless of state laws.

    “It would be an illegal gun for a non-police officer,” Brodsky said.

    Prosecutors disputed that, arguing that even with the federal law, police officers can’t carry weapons that are illegal under state law.

    Though Schoenstedt refused to dismiss the weapons charges, he indicated the crucial issue in Peterson’s trial may be whether the federal legislation supersedes state gun laws — and said he has found no clear answer to that question.

    Former Bolingbrook Police Sgt. Drew Peterson will face felony gun charges stemming from the investigation of his wife’s disappearance, after a Will County judge Wednesday denied a request to throw out the charges.

    In his ruling, Judge Richard Schoenstedt said Peterson’s legal team had failed to prove a federal statute permitted him as a law-enforcement officer to have a modified weapon that is illegal in Illinois.

    “For the defense to be successful at this stage, this court would be required to make certain assumptions on behalf of the defense and against the state,” Schoenstedt said. “Given the burden as described, this court declines to do so.”

    At question is a modified assault rifle with a barrel nearly 5 inches shorter than allowed by state law, officials said. The rifle was seized last fall after search warrants were executed as part of the investigation into the disappearance of Peterson’s fourth wife, Stacy. The Bolingbrook mother, who was 23 at the time, vanished Oct. 28, and police named Drew Peterson, 54, a suspect in the case.

    In May, shortly before Peterson was to regain possession of the weapons taken by state police, Peterson was arrested on the gun charges.

    Earlier this month, Peterson’s attorneys had argued that since he used the rifle while he was a police officer in Bolingbrook, he was exempt from state law under the federal Law Enforcement Officers Safety Act of 2004, or LEOSA.

    The federal law permits working and retired law-enforcement officers in good standing to carry a concealed firearm in any jurisdiction in the U.S., regardless of most state or local laws.

    Schoenstedt agreed that it did apply to Peterson as a qualified police officer. But he said he could not find a prior case or law that addressed whether the legality of the firearm mattered under the federal statute, or whether there was a difference between concealing and carrying a weapon, which is protected by the statute, or possessing it, which is what Peterson is charged with.

    “Obviously the prosecution is continuing, so it’s not a total victory,” Peterson’s attorney Joel Brodsky told reporters after the hearing. “But when you read the judge’s decision, there are many positive aspects. What he did is say that the LEOSA law does apply, it does cover Drew Peterson’s situation.”

    Peterson’s attorneys said they are confident that their client will be vindicated in court. They have said they have paperwork from the Bolingbrook Police Department proving that it knew Peterson used the gun as a secondary duty weapon.

  10. I’m feeling a little silly … and I’ve probably been “punked” big time … but I looked under the computer desk for Ashton Kutcher and could not find him. 😀

    Don’t ask me why this person chose me to tell. I’m really just a person from Montana who found this case interesting and found that I could follow it online.

    The kids are doing okay, considering the circumstances and were heard in the background the other day playing.

    There’s quite an extended family when it comes to the Petersons. Any indication which branch of the family the kids have been visiting with? With four marriages for their dad, not to mention the divorces and remarriages of various grandparents, there are plenty of relatives in those kids’ lives.

    Did this person indicate if he had been leaving them with any other friends, as I he had left them with Paula and Lenny?

    What do you make of that part of the message? It just seems odd to me to even mention that the kids were playing. I don’t think anyone believes that they are locked in a dungeon or denied toys.

    Did you get any feel at all for why they felt compelled to put this particular message out? It just doesn’t seem to merit the hoopla, you know what I mean? 🙂

    About 2:30 p.m., a citizen called police after seeing a body floating in the water near North Avenue Beach, police News Affairs Officer JoAnn Taylor said, citing preliminary information.

    The body of an adult female was pulled from the water, Taylor said.

    A spokesman for the Cook County Medical Examiner’s office confirmed the fatality and said they were working to identify the woman Wednesday evening.

    An autopsy is slated for Thursday.

  17. I had heard that the body was identified by her family as a 66-year-old woman that had pschological problems and had been reported missing a few days earlier.

    Not sure who did the judging to say the body was a woman in her 40s. Maybe the lady looked good for her age though – or the person that judged the age wasn’t good at that task.

Too bad they don’t create some kind of national DNA database that includes DNA from bodies found and families of missing people could submit their DNA to check against. Just a crazy thought.

  20. That would be an amazing thing if they would do that. I bet the number of Jane and Johns would go down tremdously.

    It is so odd to think that there are people out there who no one claimed. Everyone has to have someone who loved them and is looking for them but maybe they are all just a case of bad information being put out to the public and the families just dont think they match up to their missing loved one.

    Who are you really? I find it quite odd that someone in this case who doesn’t know you would give you and info that important.

    Sorry if I am a little skeptical but there have been too many people who claim to know things they have no clue about. I am not disputing that the kids have family taking care of them…… all of us who are around see that family members go and see those kids. I just don’t understand why the sudden ” Someone ” decided to contact you and release this info to you in particular.

    How did they contact you? Where did they find you … here, another forum perhaps.

    Then the odd… post this and now I am going on vacation and may not have internet.

    Seems fishy and a little off to me.

    They do have a database where DNA can be compared.. they use it frequently. But.. they need more cooperation between states, counties, ect to help get it done more efficiently.

    The fact that they know it is a woman looks like it rules out alot of people we would be hoping it would be, but hopefully it answers some questions for some family somewhere.

    FROM STNG WIRE REPORTS

    A woman whose body was found floating naked in Lake Michigan near North Avenue Beach Wednesday afternoon was reported missing by family members days earlier, authorities said.

    A civilian called police after seeing the body floating in the water near North Avenue Beach and crews pulled it from the water about 2:10 p.m., police said.

    The woman, 66, whose name is not being released early Thursday, was dead on the scene, said the Cook County Medical Examiner’s office. An autopsy is scheduled for later Thursday.

    Police Marine Unit Officer Kevin Kelly said the Caucasian woman was not clothed when she was found and she appeared to be recently deceased. She had no visible signs of trauma.

    The woman’s family reported her missing a couple of days ago and she may have suffered from a mental disability. The woman’s family may release a statement later Thursday to release her name, authorities said.

    Belmont Area detectives are investigating.

  27. This time of year (hot sticky days plus hot sticky nights) there are a lot of people out by the lakefront at all hours, and they do fall in (people like to sit and drink there too). People also unfortunately do sometimes jump in.

    I always assume lakefront drownings are accidental until I hear otherwise.

    Don’t have alot of missing people in my area, seems like lake Michigan/Chicago area has alot, someone is always going missing or being found.

    That is exactly what I was saying about the naked thing. It makes me think sexual assault.. but then the age.. ugh..

    The article said the family may make a statement about it later. I’m not used to the media being so sensitive about releasing the name of someone that was identified. They sometimes release the names of victims before some family members have been notified.

    Sometimes they release the names of underage victims, sometimes they don’t.. sometimes they release the names of kids who have been involved in crimes underage, and sometimes they don’t.

    I’m wondering if there is some sort of accepted rule or standard they go by, or if they try to get permission from the family, or the police?

    Or is it just up to each reporter?

  41. iamseppy – I think they sometimes just go by the seat of their pants. I know that they released the name of a minor in our area that had crashed her car into a pizza place. I also know they released the names of the children killed in the Oswego crash before my brother was able to call me to let me know his wife’s nephew was killed in the crash.

    I believe there are no laws regarding this. Each news source probably has their own set of rules. The only thing I think they aren’t allowed to do is list the name of a minor charged with a crime (although I’ve seen reports that list the names of 17 year olds sometimes).

    I think they don’t print the names of a victim of a sexual attack out of respect for their privacy and so as not to further victimize them.

    Jennifer Schoon, the former girlfriend of Drew Peterson’s son Steve testified before the grand jury Thursday.

    Schoon and her attorney Thomas Glasgow exited the Will County Court Annex building at about 12:45 p.m.

    “(Schoon) was the girlfriend of Steve Peterson and lived in the house with Drew Peterson and Steve Peterson during the time that Kathleen Savio’s body was discovered,” Glasgow said.

    Glasgow said Schoon testified extensively but declined to comment on the content of the testimony.

  46. I kind of thought the first indictment of Drew Peterson would have to do with KS’s death, but, obviously, they’re still considering testimony for that. Maybe DP will make another one of his statements about being perplexed as to why they’d call that person to the GJ.

  54. I think they were hinting that they knew about a history between Steven and this girlfriend, I can’t remember the exact accusation though, I remember people kept asking them to either say it or hush about it, and I don’t remember if they ever came out with it.

    But basically this girl had lived with him at DP’s house and there had been a falling out. That’s all I can remember, was hoping someone else had it.

    I am most certain they are brothers. James and Tom Glasgow…went to school with them in Joliet.

    Also, Jennifer Schoon, ex-live in girl friend of Steve’s….I remember hearing they broke up because he cheated and or abused her?? Anyone else remember this?

    It was indeed both, cheating and abuse that I remember.

    If I were this girl I would most definately have legal representation! Drew and his whole family are just the type to serve revenge in a least expecting way.

    This girl also lived in the Drew/Stacy house for a short period of time? or not? maybe this was a different girl. I have no doubt she was able to inform the GJ of things they had not heard until today….hummmm?

    The parts of a skull found Wednesday evening near the Mill Street Bridge of the Vermilion River are “believed to be human in nature,” according to Livingston County Coroner Michael P. Burke.

    “The pieces of bone were retrieved from the site and sent for a preliminary evaluation to one of our forensic pathologists. After his initial exam, he believed the pieces of skull to be human in nature,” Burke said this morning.

    Pontiac Police Maj. Jim Woolford said that at 6:31 p.m. Wednesday his department was notified that a 49-year-old male fishing with two juveniles, near the Vermilion River Bridge at Mill Street not far from the dam, had located what appeared to be a partial skull in shallow water.

    “Officers’ reports on this incident indicate that the front upper portion of a skull was found. In this portion of the skull there was no skin attached and there were no teeth or jaw. Also found was what appeared to be the top of a head, a short ways away, in the water. These items were turned over to the the coroner,” said Woolford.

    The items were found along the north edge of the river, just west of the dam, according to Burke.

    “The two pieces of bone are from the same skull and show signs of environmental wearing or weathering. The origin of the skull is unknown but possibly it may have been carried down stream during the earlier spring flooding and deposited at the site near the dam where it was found,” said Burke.

    “The bone fragments like all other bone fragments found in this county will be forwarded to a forensic anthropologist for further evaluation,” said the coroner.
